UPDATE ON REVISED CDM REGULATIONS

The Association for Project Safety ( APS ) have reported :- The HSE have informed us that their recently submitted Regulatory Impact Assessment for CDM 2014 has been returned by the Regulatory Policy Committee and there is some additional work for the HSE to do. This further information will then need to be re-considered by the RPC. This review process is outwith the control of the HSE which means that the anticipated publication date for the consultation package will now be delayed from late August/early September by anything up to 5 weeks. We still understand that the HSE plan to hold a 3 month industry consultation period. We are led to believe that the HSE may be proposing: Removal of the independent CDM Co-ordinator role and placing Design Phase health and safety coordination with a lead designer with a new title of ‘Principal Designer’ (working title); Removal of the Appendix 4 Competence Assessment criteria; Placing construction phase co-ordination duties with the Principal Contractor; Full application of CDM Regulations to all projects with more than one contractor on site (including domestic projects). A series of APS-run Consultation Seminars are being held during the Autumn for the whole construction industry to take part in. The HSE have said that they will be involved in presenting some of these seminars alongside APS.
