There is a lot of turmoil, conjecture, misunderstanding and misinformation surrounding the implementation of the Regulations at this time and many Practices are refusing or are finding themselves unable to carry out the duties of Principal Designer. Others are swayed by commercial pressures or have disagreement internally.
D&B is proving a problem with some insurers refusing to provide PD cover to novated Practices, which reinforces our belief that PD should be a direct appointment to the Client (a view endorsed by most Directors of Estates I have spoken to), although KOK remain flexible to suit particular circumstances or demands.

Many forget that the PD role is with regards to construction health and safety matters only, and Clients and designers need advice from people who are immersed in that subject.

KOK have a one stop solution. We will perform the duties of clients CDM consultant and the duties of PD or PD advisor as circumstances demand, thereby ensuring that the Client effectively discharges his legal obligations throughout the project as required by the regulations and also that the management, monitoring and Control of Health and Safety matters during design is embedded within the Project Team.

already has £5million PI cover covering Principal Designer duties,
are a Designer as defined by CDM 2015,
have effectively been carrying out PD duties since 2007 or before (as added value),
have effectively been carrying out the client duties required by CDM 2015 (as added value) since 2007,
possess the skills, knowledge, training, experience, and organisational capability required by construction health and safety legislation to fulfil these roles,
are working with major clients and designers to amend their procedures to the new Regulations,
already have our QA system successfully audited and accredited for these “new” services.
